1. General
1.1. This is the privacy policy document (hereinafter: the “Privacy Policy”) of the website of the Kibbutz Lavi Hotel, located at: hotel@lavi.co.il (hereinafter: the “Website”).
1.2. The Hotel is operated by Lavi Guest Hotel in the Heart of the Galilee – Agricultural Cooperative Society Ltd., Company Number: 570053520 (hereinafter: the “Hotel” and/or the “Cooperative”).
1.3. The Website provides information about the Hotel and its services and includes a digital booking engine for reserving vacation stays at the Hotel (hereinafter: the “Services”).
1.4. The Cooperative respects the privacy of users of the Website. Therefore, through this Privacy Policy document, the Cooperative seeks to inform users of the Website about the privacy practices in effect.
1.5. The mere use of the Website, placing a reservation through it, or providing personal information via the Website constitutes unconditional consent to the terms of this Privacy Policy. You shall have no claim and/or demand against the Cooperative and/or anyone on its behalf, except in the case of a breach of an express obligation by the Cooperative under this Privacy Policy.
1.6. The Cooperative reserves the right to update and amend the provisions of this Privacy Policy from time to time, at its sole discretion and without prior notice. Any change shall take effect immediately upon its publication on the Website.
1.7. This Privacy Policy is written in the masculine form for convenience only and refers equally to all genders. Any reference in the singular also applies to the plural and vice versa.
 
2. Registration and Information Provided by the User
2.1. To complete a transaction through the Website, you will be required to register on the Website and/or fill in personal details and/or log in using your Google account credentials (hereinafter: the “Registration”). As part of the Registration and/or while completing the transaction, you may be asked to provide details such as, but not limited to, first name, last name, email address, phone number, etc.
2.2. Some of the details requested during the Registration process will be marked as “mandatory fields,” and without providing the required information, Registration and/or purchase will not be possible. Furthermore, certain services offered through the Website may only be available to users who have completed the Registration process.
2.3. Additionally, when contacting us, whether by email or any other means, we may receive personal information about you.
2.4. Under no circumstances will the Cooperative store your credit card information. As part of the payment process, a secure, dedicated page operated by the payment processor will open. The information you provide on this page will be submitted directly to the payment processor for the purpose of processing the payment, and will be stored by them in accordance with applicable law.
2.5. In addition, while completing a reservation at the Hotel, we may collect information regarding your stay, such as services used during your visit, including room service, use of Hotel facilities, participation in activities, customer service inquiries, feedback, interests, personal preferences (including dietary or medical preferences, if provided by you), and footage from the Hotel’s security cameras.
2.6. The owner of the database in which your personal information is stored is the Cooperative, whose contact details are listed in Section 13 below.
2.7. It is important to note that you are not legally required to provide this information; however, without providing it, you may be unable to purchase Services through the Website.
 
3. Information Collected During Use of the Website
3.1. In addition to the personal information you may voluntarily provide, a significant amount of non-personally identifiable, statistical information is collected automatically during your use of the website. This information may include, among other things, the pages viewed on the website, links clicked, the websites users came from before arriving at the website, the duration of time spent on the website, the operating systems and internet browsers used, the countries from which users are accessing the website, and similar technical data.
3.2. In addition, the Cooperative may collect commercial information, such as records of services purchased and histories of service purchases or use. The Cooperative may also collect customer record information, such as billing or service addresses, contact details of the contract holder, and similar account information, or any combination of the foregoing.
3.3. The website may also use data and non-personally identifiable information to anonymously analyze how long visitors spend on each webpage, how many visitors browse the website, and how the Cooperative can better tailor its webpages to the needs of users and visitors. This data may be aggregated, and any use of such data will be conducted in an anonymous manner.
3.4. The Cooperative may use various technologies to collect and store information during your use of the website, including Cookies, Pixel Tags, Server-Side Tracking, and similar technologies. These technologies may collect data such as device type, operating system, browsing patterns, actions performed on the website, preferences, and additional usage information. These technologies are used, among other purposes, for operation, measurement, and analysis of user activity, enhancing user experience, and displaying personalized content and services.
3.5. The Cooperative may collect and rely on the services of third parties (e.g., Google Analytics, Meta, and others) to collect and analyze anonymous, statistical, or aggregated information regarding your use of the website, including information related to your details and activity on the website.
 
4. Use of Information
4.1.    The information you provide, as well as data collected during your use of the Website, will be used solely in accordance with this Privacy Policy or as permitted by applicable law, including for the following purposes:
4.1.1. To enable you to use the services on the Website and to purchase services;
4.1.2. To manage reservations and your stay at the Hotel, including billing, collection, and the provision of services during your stay;
4.1.3. To contact you and send you notifications, including via email, phone, text messages, and WhatsApp;
4.1.4. To respond to inquiries you submit through the “Contact Us” form on the Website;
4.1.5. To identify you during future visits to registered areas of the Website, to avoid re-entering your details each time, and to allow cancellation or modification of reservations made through the Website;
4.1.6. To improve and enhance the services and content offered on the Website, including the development of new services and content tailored to users’ preferences and expectations, and to modify or cancel existing services and content;
4.1.7. To offer you services and marketing promotions, and to tailor advertisements and marketing messages to your preferences and/or purchasing habits, such as special offers, coupons, and promotions;
4.1.8. For the operation, development, improvement, and management of the Website, as well as for improving the service and adapting it to the customer.
4.1.9. To conduct satisfaction surveys and analyze feedback to improve service;
4.1.10. For the purpose of maintaining security, safety, and property;
4.1.11. For any other purpose detailed in this Privacy Policy or in the Website’s Terms of Use.
 
5. Disclosure of Personal Information to Third Parties
5.1. The Cooperative undertakes to protect your personally identifiable information in accordance with the Protection of Privacy Law, 1981 (hereinafter: the "Protection of Privacy Law"), and will not transfer such information to third parties except in the following cases:
5.1.1. When purchasing services through the Website, the Cooperative may transfer the information to suppliers to whom the transfer is necessary for the provision of such services (e.g., payment processors, the operator of the Website and its reservation system, payment processing systems, and credit card companies);
5.1.2. The Cooperative may transfer your information to its subsidiaries, parent companies, affiliates and/or other entities related to the Hotel and the Cooperative and/or related to the provision of the services and/or to Kibbutz Lavi;
5.1.3. To contractors or service providers engaged by us for the purpose of providing or improving services;
5.1.4. To our professional advisors (such as attorneys and accountants), as required for the provision of their services;
5.1.5. If you breach the Website’s Terms of Use or the terms of any agreement you have accepted in connection with your use or activity on the Website;
5.1.6. If you perform or attempt to perform, through or in connection with the Website, actions that appear to violate applicable law;
5.1.7. If the Cooperative receives a judicial order requiring it to disclose your details or information about you to a third party;
5.1.8. In any dispute, claim, demand, or legal proceeding, if any, between you and the Cooperative and/or anyone acting on its behalf;
5.1.9. In any case where the Cooperative, in its sole discretion, deems the disclosure of the information necessary to prevent harm to your body or property or to the body or property of a third party;
5.1.10. The Cooperative may share anonymous, aggregated, or statistical information with companies or organizations involved in the ongoing operation of the Website, as well as with suppliers, business partners, advertisers, or any other third party at its sole discretion;
5.1.11. If the Cooperative organizes the Website's operations under another business entity, or in the event of a merger with another entity or the merger of the Website’s operations with those of a third party, the Cooperative may transfer a copy of the information collected about you, as well as any statistical data, to the new entity, provided that such entity assumes the provisions of this Privacy Policy.
5.2. The servers on which the information will be stored may be located outside the State of Israel and may be subject to the privacy protection laws of other jurisdictions, including countries that may not provide the same level of protection as Israeli law. You hereby expressly consent to the Cooperative transferring the information collected about you, in accordance with this Privacy Policy, to such jurisdictions.
 
6. Direct Mailing and Promotional Messages
6.1. We may use your contact details to stay in touch with you and to offer and send you promotional and marketing content from various sources, direct mailing, newsletters, updates, advertisements, and other messages related to the services and the Website (hereinafter: “Mailing”).
6.2. The Mailing may be sent to you via email, SMS text messages, or any other method of communication. If you do not wish to receive promotional Mailing, you may request to be removed from our mailing list by clicking the unsubscribe link included in any electronic advertisement sent to you, or by contacting us at: hotel@lavi.co.il.
6.3. We will remove your details from the mailing list in accordance with your request and in compliance with the provisions of the Israeli Communications Law (Telecommunications and Broadcasting), 1982, and the Protection of Privacy Law, 1981.
 
7. Links to Other Websites
The Website may contain links to various websites on the Internet that are not operated by the Cooperative and that are subject to different privacy policies. Although the Cooperative seeks to link only to reliable and trustworthy websites, it is not responsible for the privacy practices or the data protection systems and procedures implemented by such websites, nor for any information collected by those websites or third parties that are not governed by this Privacy Policy. You are encouraged to review the terms of use and privacy policies of such websites or third parties before using them.
 
8. Data Security
8.1. The Website and the server on which the information is stored implement standard systems and procedures for data security. While these systems and procedures reduce the risk of unauthorized access, they do not provide absolute security. Therefore, there is no guarantee that the Website and server will be completely immune from unauthorized access to the stored information. You agree to the collection and submission of information about you in accordance with this Privacy Policy and accept the risk of data security incidents that may affect the confidentiality, integrity, or availability of such information.
8.2. By using and making purchases on the Website, you declare that you will not have any claim and/or demand and/or suit against the Cooperative and/or anyone on its behalf due to breaches, intrusions, malfunctions, and/or disruptions of any kind on the Website, provided that such occurrences were beyond the Cooperative’s control and it made reasonable efforts to prevent them.
 
9. Data Retention
The Cooperative will retain personal information for the period necessary to fulfill the purposes for which it was collected, including to comply with its legal obligations, including reporting obligations.
To determine the appropriate retention period for personal information, the Cooperative will consider, among other things, the purpose for which the information was collected, its scope, nature, and sensitivity, the risk of harm from unauthorized access, the period during which the Cooperative may need to retain the personal information to comply with legal requirements or to manage legal proceedings, and in accordance with any applicable time limitations permitted by law for retaining any such data, to the extent that such limitations exist under applicable legal provisions. 
 
10. Minors
The Website and the services offered through it are not intended for minors under the age of 18, and the Cooperative does not knowingly collect personal information from individuals under the age of 18. If you are a parent or legal guardian of a minor under the age of 18 and believe that your child is using the Website, please notify us immediately. In such cases, the Cooperative may request personal information from you to verify your identity as the parent or guardian.
 
11. Right to Access Information
Under the Protection of Privacy Law, you are entitled to review any information held by the Cooperative about you, either personally or through a representative authorized in writing. If you find that the information is incorrect, incomplete, unclear, or outdated, you may contact the database owner with a request to correct or delete the information. The right of access shall be exercised in accordance with applicable law, including the Privacy Protection Regulations (Conditions for Viewing Information and Procedures for Appealing a Refusal to a Request to View), 1981.
 
12. Governing Law and Jurisdiction
12.1. This Privacy Policy and any legal obligations of the Parties shall be governed by and construed in accordance with the laws of the State of Israel, regardless of the user’s place of residence.
12.2. Any claim and/or complaint and/or legal action relating to this Privacy Policy shall be submitted and adjudicated exclusively in Israel, in the competent courts located within the jurisdiction of the Tel Aviv District, Israel.
